Terms and Conditions

Tiga Mata is a bi-annual photography zine published by Zontiga (The Next Level Sdn Bhd), based in Petaling Jaya, Malaysia.

By submitting work to Zontiga for possible inclusion in Tiga Mata: Issue #5 – Truth Flux, you acknowledge that you have read, understood, and agreed to the following Terms and Conditions. These Terms constitute an agreement between you (the entrant) and Zontiga (The Next Level Sdn Bhd).

Eligibility and Submission

  1. Submission to this Open Call is open to eligible participants as outlined in the submission guidelines.
  2. Each entrant may submit up to ten (10) photographs and must provide all required accompanying text/written material as specified. Submissions that are incomplete, incorrectly prepared, or fail to meet the stated requirements may not be reviewed.
  3. Zontiga does not guarantee the selection or publication of any submitted work.

Submissions by Minors

  1. If the entrant is under the age of sixteen (16), the submission must be accompanied by written consent from a parent or legal guardian.
  2. Submissions by minors that are not accompanied by the required consent may be excluded from consideration.

Responsibility and Content Standards

  1. The entrant confirms that they are solely responsible for the submitted works.
  2. Works deemed by the organiser to be exploitative, obscene, pornographic, or in violation of applicable laws or ethical standards may be excluded from the selection process at the organiser’s discretion.
  3. If children or minors appear in submitted images, the photographer is responsible for obtaining consent from the child and their legal guardian wherever reasonably possible.

Copyright

  1. Copyright in all submitted works remains with the respective photographer, artist, or rights holder.
  2. Submission of work to Tiga Mata does not constitute a transfer of copyright to Zontiga (The Next Level Sdn Bhd).

Rights and Usage

By submitting work, entrants grant Zontiga (The Next Level Sdn Bhd) and any appointed guest curator or editor a non-exclusive, royalty-free licence to use selected works for purposes directly related to Tiga Mata, including but not limited to:

  • Print and digital publication
  • Exhibition and display
  • Promotion, press, and communication
  • Educational and editorial use
  • Archival and documentation purposes


All uses will credit the artist by name or upon request by their stated artist name or pseudonym, and where possible, their nationality.

Duration of Usage Rights

  1. Promotional and marketing use of submitted works shall be limited to a period of thirty-six (36) months from the close of the Open Call.
  2. Archival, editorial, and documentation use, including institutional records, historical reference, and non-commercial archives may continue without time limitation.
  3. These usage rights do not constitute a transfer of copyright.

Permissions and Releases

  1. The entrant confirms that they hold the necessary rights to submit the work and that all required permissions, releases, or consents have been obtained for the intended uses related to the publication, promotion, and documentation of Tiga Mata.
  2. Zontiga (The Next Level Sdn Bhd) shall not be held responsible for claims arising from the failure to obtain such permissions.

Editorial Discretion

  1. Zontiga (The Next Level Sdn Bhd) retains full editorial discretion over the selection, presentation, sequencing, and contextualisation of submitted works.
  2. Selected works may be presented individually or in combination with other works and may be placed into new curatorial or editorial contexts.

No Compensation

Entrants acknowledge that participation in this Open Call is voluntary and that no monetary compensation will be provided for the publication or use of submitted works as outlined in these Terms.

Waiver of Claims

Entrants acknowledge that Zontiga (The Next Level Sdn Bhd) does not guarantee the selection or publication of submitted works and waive all claims against the organiser arising from non-selection, non-publication, or editorial decisions made in accordance with these Terms.

Acceptance of Terms

  1. Submission of work constitutes full acceptance of these Terms and Conditions.
  2. Zontiga (The Next Level Sdn Bhd) reserves the right to amend these Terms at any time, with updated versions made available through official communication channels.
